These Terms & Conditions govern your use of our services, including but not limited to custom web development, e-commerce solutions, workflow automation (n8n), SEO, analytics, hosting, VPN services, and custom support, as well as our website (www.enlab.net). By engaging with us, you agree to these terms. Please read them carefully.

1. Definitions

  • “We,” “Us,” “Enlab Tech”: Enlab Tech, a privately held IT Services and Consulting company based in Dhaka, Bangladesh.
  • “You,” “Client”: The individual or entity engaging our services or visiting our website.
  • “Services”: Our 530+ offerings, including WordPress, Shopify, Odoo, Squarespace, Webflow, n8n, SEO, analytics, hosting, VPN, and custom support, as listed on www.enlab.net or in our service agreements.

2. Service Agreement

  • Scope: We provide services as outlined in project proposals or agreements. Services include website development, e-commerce setup, automation, SEO, hosting, VPN, and support.
  • Proposals: Project scope, timeline, and budget are detailed in a customized proposal. Any changes (e.g., additional features) may affect cost and timeline, subject to mutual agreement.
  • Client Responsibilities: You agree to provide accurate project details, assets, and timely feedback. Delays in providing information may impact delivery timelines.

3. Payment Terms

  • Fees: Service fees are outlined in the project proposal. Payments are due as agreed (e.g., upfront, milestone-based, or upon completion).
  • Methods: Payments are accepted via bank transfer, credit card, or other methods specified in the proposal.
  • Late Payments: Overdue payments may incur a 1.5% monthly interest fee or the maximum allowed by law.
  • Refunds: Refunds are not provided for completed work. Partial refunds for incomplete projects are at our discretion, based on work performed.

4. Intellectual Property

  • Client Content: You retain ownership of content provided (e.g., logos, text, images). You grant us a license to use this content for service delivery.
  • Enlab Tech Content: We retain ownership of proprietary code, templates, or tools developed by us unless otherwise agreed in writing.
  • Deliverables: Upon full payment, you receive a non-exclusive license to use deliverables (e.g., websites, plugins) for their intended purpose. Ownership transfer may be negotiated separately.

5. Confidentiality

We will protect confidential information you share during projects (e.g., business data, API keys). We will not disclose it to third parties except as required for service delivery (e.g., to hosting providers) or by law.

6. Service Delivery and Support

  • Timelines: Project timelines are estimates based on scope. Delays due to client feedback or unforeseen issues may adjust delivery dates.
  • Support: Post-launch support (e.g., maintenance, updates) is provided as per the service agreement. Emergency support is available 24/7 via info@enlab.net or +880-9658002596.
  • Revisions: Minor design edits are included during the design phase. Additional revisions may incur fees.

7. Limitation of Liability

  • No Warranty: Services are provided “as is.” We do not guarantee specific outcomes (e.g., SEO rankings, website traffic) due to factors beyond our control.
  • Liability Cap: Our liability is limited to the amount paid for the services. We are not liable for indirect damages (e.g., lost profits, data loss).
  • Third-Party Services: We are not responsible for issues caused by third-party platforms (e.g., Shopify, Google Analytics, AWS).

8. Termination

  • By Client: You may terminate a project with written notice. Fees for work completed are non-refundable.
  • By Enlab Tech: We may terminate services for non-payment, breach of terms, or uncooperative behavior, with written notice.
  • Effect of Termination: Upon termination, you will receive deliverables for paid work, and we will return or delete your confidential data as required.

9. Governing Law

These terms are governed by the laws of Bangladesh. Any disputes will be resolved in the courts of Dhaka, Bangladesh.

10. Changes to Terms

We may update these Terms & Conditions to reflect changes in our services or legal requirements. Updates will be posted on www.enlab.net with the effective date. Continued use of our services constitutes acceptance of the updated terms.
